The following privacy notice informs you about the nature and scope of the processing of your personal data by myTalentscout GmbH. Personal data is information that relates, or can be related, directly or indirectly to a person. In this context, we distinguish between you as a prospective candidate and as a candidate. A prospective candidate shows interest in an open role or a position at a company. This means that the person would like to obtain information but does not yet wish to apply actively. A candidate actively applies for an open role, is interested in an interview, submits personal and professional data by means of a CV, and is thereafter managed as a candidate for one or more roles.

2. Purposes of processing and legal bases
2.1 Types of data
2.1.A Prospective candidate
If you are listed with us as a prospective candidate, we may process the following data or categories of data:
- name
- LinkedIn website / Xing website
- candidate ID
- source
- creation date
- date of last modification
- previous communication
- relevant data from your publicly visible Xing or LinkedIn profile page
- and any other data that you voluntarily provide to us during the initiation process.
2.1.B Candidate
If you apply to us, we may process the following data or categories of data:
- master data (gender, surname, first name)
- contact data (address, telephone number, email address)
- date and place of birth
- nationality
- data concerning school and vocational education (start and end of education, type of educational institution, type of qualification)
- data concerning professional experience (name of company, type of activity, start and end of activity)
- data concerning further training (start and end of training, type of training provider, content of training)
- language skills and other job-related data
- data concerning a driving licence or ownership of a vehicle
- health-related information
- relevant data from your publicly visible Xing or LinkedIn profile page
- and any other data that you voluntarily provide to us during the initiation process.
2.2 Processing of your data
2.2.A Prospective candidate
Your personal data (2.1.A) is stored only by the professional network through which previous contact with you was conducted. No summary or enrichment with other profile data takes place. The aforementioned data is processed only for the transitional period from the first appointment scheduling until the later upload of the data, which is carried out by the prospective candidate personally. Only after confirmation of the introductory meeting and acknowledgement of the enclosed privacy notice will the above-mentioned data be uploaded. Data processing agreements have been concluded with all processors.
The purpose of the processing is to ensure a consistent placement process throughout the entire procedure and despite changing contact persons at the controller. Previous arrangements and discussion content from the meeting should be retained. This enables an effective placement process and the offering of current placement proposals tailored to the wishes and expectations of the prospective candidate.
The processing of your data is necessary to safeguard our legitimate interest as a company. The legal basis for this is Article 6(1)(f) GDPR.
Our legitimate interest arises from the optimisation of our business processes and the improvement of our offering to our customers.
Where your personal data is processed on the basis of our legitimate interest pursuant to Article 6(1), sentence 1, point (f) GDPR, you have the right, pursuant to Article 21 GDPR, to object to the processing of your personal data where there are grounds relating to your particular situation.
2.2.B Candidate
If a prospective candidate decides to actively start the placement process, they may upload their further data (see 2.1.B) on our website at https://mytalentscout.de. This is linked to express consent to the processing of their personal data for the purpose of job placement. After successful upload and granting of consent, the prospective candidate becomes a candidate.
We process the data you submit exclusively on the basis of your voluntary consent for the purpose of being able to place suitable job offers with our clients (companies), to handle the placement process, and to determine your suitability as a candidate. Where necessary, this also includes the permissible enrichment of your profile by using publicly visible data from work-related social networks (Xing/LinkedIn). The legal basis for this is Article 6(1)(a) GDPR and/or Article 9(2)(a) GDPR.
Right of withdrawal: You have the right at any time to withdraw consent granted to us with effect for the future, informally and without stating reasons (for example by email to info@mytalentscout.de). After withdrawal, the placement process will be stopped immediately and your data will be erased without undue delay, unless statutory retention obligations prevent erasure.
Our decision-making in the application process is not based solely on automated processing. Accordingly, no automated individual decision-making within the meaning of Article 22 GDPR takes place.
2.3 Contacting us
If you contact us by telephone, email or post, your details will be processed for the preparation, handling and completion of the contact pursuant to Article 6(1)(f) or Article 6(1)(a) GDPR. The data collected in this context, such as your name, email address, postal address and telephone number, will be used solely for the purpose of contacting you, handling your enquiry or responding to follow-up questions. You have the right at any time to withdraw consent granted to us with effect for the future.
3. Sources of the data
We process personal data that we receive from you in the context of contacting us or your application by email or via the web form. If you have an account on the career-oriented social networks Xing or LinkedIn, it is possible that we also collect data from your publicly visible profile page.
4. Duration of data storage
4.A Prospective candidate
If the prospective candidate decides after the introductory meeting not to proceed with placement, the aforementioned data (2.1.A) will be completely erased after no later than 6 months. In this case, there is no upload of the candidate's data via the controller's website and therefore no consent to data disclosure.
Upon upload and corresponding consent, the prospective candidate profile becomes the candidate profile. All previous data is transferred and supplemented with the new data from the CV. The original prospective candidate profile is deleted.
4.B Candidate
The personal data submitted with an application will be stored for the duration of the application process. If the application process ends with a rejection or placement, your data will be retained for a maximum of six months and then erased, unless other legitimate interests on our part prevent erasure or we are obliged to retain it for a longer period due to tax and commercial-law retention and documentation obligations (under the German Commercial Code (HGB), the German VAT Act (UStG) or the German Fiscal Code (AO)). Other legitimate interests in this sense include, for example, an evidentiary obligation in proceedings under the German General Equal Treatment Act (AGG).
If your application is to be included in our talent pool for future job postings, retention and use for a longer period may be considered. In this case, we will ask you for your consent pursuant to Article 6(1)(a) GDPR and/or Article 9(2)(a) GDPR.
Contact data will be erased after final handling of your or our enquiry. This is the case when knowledge of the data is no longer necessary to fulfil the purpose pursued by the storage, or when storage is or has become inadmissible for other statutory reasons, provided that no statutory retention obligations apply.
5. Disclosure of your data
Your personal data is transmitted to our customers only after a detailed interview, including your professional and private wishes, has taken place with one of our consultants.
For processing and storing your data, we use the “Leonar” platform of Licorne Society SAS, 19A rue du Rocher, 75008 Paris, France. We also use Leonar for the organisation, structuring and multi-channel management of candidate communication and for managing the application process.
Where applicable, we also use service providers for the maintenance of our IT infrastructure and the management of our domain. We select our service providers carefully - in particular with regard to data protection and data security - and take all measures required under data protection law for lawful data processing.
All employees, third parties involved in data processing and our contractual partners are obliged to treat personal data confidentially. Data processing agreements have been concluded with all processors.
6. Transfer to a third country
In connection with the use of the “Leonar” platform (Licorne Society SAS), data is transferred to service providers located in a third country outside the European Union (EU) or the European Economic Area (EEA), namely the USA. An adequate level of data protection is ensured by the existence of an adequacy decision of the European Commission (EU-US Data Privacy Framework) or by the conclusion of EU Standard Contractual Clauses. You may request a copy of these safeguards using the contact details stated above.
7. Your rights
With regard to the personal data concerning you, you have the following rights against us:
- to withdraw consent granted to us pursuant to Article 7 GDPR,
- to request confirmation as to whether personal data relating to you is being processed (Article 15 GDPR),
- to receive, at any time and free of charge, information about the personal data stored about you and a copy of that information (Article 15 GDPR),
- to request the immediate rectification of inaccurate personal data concerning you or the completion of such data (Article 16 GDPR),
- to request the erasure of your personal data without undue delay, for example upon withdrawal of consent (Article 17 GDPR),
- to request restriction of processing under certain conditions (Article 18 GDPR),
- to data portability, which includes the right to receive the relevant personal data that you have provided in a structured, commonly used and machine-readable format (Article 20 GDPR),
- to lodge a complaint with a data protection supervisory authority about the processing of your personal data by us (Article 77 GDPR).

8. Right to object
Where your personal data is processed on the basis of legitimate interests pursuant to Article 6(1)(f) GDPR, you have the right, pursuant to Article 21 GDPR, to object to the processing of your personal data with effect for the future where there are grounds relating to your particular situation.
